The 2026 fall burning season runs from Oct. 1 through Dec. 31, with outdoor burning strictly restricted to the hours between 5 p.m. and 7 a.m. Any fire started after 5 p.m. must be completely put out by 7 a.m.
Only vegetative materials such as leaves, brush, and yard clippings may be burned. Fires must be watched by an adult at all times until completely extinguished. Clear at least a 10-foot area of all burnable material around the fire.
Small campfires or fires used strictly for food preparation, light, or warmth are exempt from the 5 p.m. to 7 a.m. time rule (though general safety precautions still apply).
Commercial burning during restricted hours requires a specialized permit issued by the West Virginia Division of Forestry. Violating state burning laws is punishable by fines up to $1,000. If an escaped fire causes a wildfire due to negligence, you can be held legally and financially liable for the total cost of fire suppression and property damage.
